Uttar Pradesh

The Uttar Pradesh Electricity Regulatory Commission has issued the Multi Year Tariff for Distribution and Transmission regulations dated 23rd September 2019. The primary purpose of these regulations is to determine the ARR, APR, Tariff, True-Up and related matters of Transmission and Distribution licensees from April 01, 2020 up to March 31, 2025.

Objectives
For determination of ARR, APR,Tariff, True-Up and related matters of Transmission and Distribution licensees from April 01, 2020 up to March 31, 2025
Regulations called as
Uttar Pradesh Electricity Regulatory Commission (Multi Year Tariff for Dstribution and Transmission) Regulations, 2019 [Clause 1.1]
Effective Control period
1.4.2020 to 31.3.2025 (5 years)
[Clause No. 1.4]
Cut-off Date
31st March of the year closing after two years of the year of commercial operation of the project and in case a project is declared under commercial operation in the last quarter of a year, cut-off date shall be the 31st march of the year closing after 3 years of the year of commercial operation. [clause 2.1 (13)]
Useful Life
AC and DC sub-station- 25 years
Gas Insulated Substation (GIS) – 25 years
Transmission line (including HVAC & HVDC) - 35 years
Controllable Factors
The “controllable factors” shall include but shall not be limited to the following:
a. Variations in capital expenditure on account of time and/or cost overrun on account of land acquisition issues;
b. Efficiency in the implementation of the project not involving approved change in scope of such project, change in statutory levies or change in law
or force majeure events and delay in execution of the project on account of contractor or supplier or agency of the transmission or Distribution licensee;
c. Bad debts;
d. Variations in performance parameters and standards specified;
e. Variations in working capital;
f. Variation in fianancing pattern due to variation in capitalisation
g. Variation in distribution losses
h. Variation in quality of supply
i. Variation in O&M expense

Un-controllable Factors
The “uncontrollable factors” shall comprise the following factors:
a. Force Majeure events;
b. Change in law; and
c. Taxes, duties and statutory levies;
d. Variation in the approved cost of power purchase from approved sources, subject to clauses in the power purchase agreement or arrangement approved by the commission;
e. Variation in interest rate for long-term loans;
f. Other expense- salary revisions due to Pay Commissions or any other expense allowed after prudence check

Sharing Norms
The approved aggregate gain or loss to the licensee on account of uncontrollable factors shall be adjusted in the ARR or Tariff of the licensee as may be determined in the order of the commission

Components of transmission tariff
1. Transmission system access charges
2. Annual Transmission charges
3. Per unit charges for energy transmitted
4. Reactive energy charges
Provided that reactive energy charges would be determined vide UPERC Open Access Regulations, amended from time to time.
Provided further that in case of competitively awarded Tranmission system project, annual transmission charges shall be as per the Annual Transmission Service Charges (TSC) quoted by such competitively awarded transmission projects.
